Scope and Validity of Conditions

1.1 These general terms and conditions of Saunum Saunas OÜ (hereinafter referred to as the Seller) for the online store (hereinafter referred to as the Conditions) apply to all individuals (hereinafter referred to as the Buyer) using the www.saunum.com online store (hereinafter referred to as the online store), ordering goods and services (hereinafter referred to as the Goods) from the online store, including entering into a purchase and sale agreement (hereinafter referred to as the Sales Agreement) to purchase goods from the online store.

1.2 By accepting these Conditions, the Buyer confirms that they have read and agree to the Sales Agreement and will comply with it.

Purchasing Goods and Placing Orders in the Online Store

2.1 The price and availability of the Goods may change without notice. If the Buyer places an order before the price of the Goods changes, the price applicable at the time of the order will apply.

2.2 The Seller has the right to withdraw from the Sales Agreement concluded through the online store and not deliver the ordered Goods or provide the service in the following cases: the Goods are out of stock; the Goods have the status “Ordering” in the online store and are out of stock; the price or characteristics of the Goods have been incorrectly displayed in the online store due to a system error.

2.3 Shopping cart and order placement

The quantity of Goods in the shopping cart can be changed. It is possible to add other products and services compatible with the selected Goods to the shopping cart. To order the Goods, the Buyer must choose a suitable delivery method. Specific details about the delivery method will be requested on the order placement page. The Buyer can familiarize themselves with the online store’s purchase conditions and, upon agreeing to them, confirm it by marking (checking) the conditions.

To confirm the order, the Buyer must press the “Place Order” button, and the Buyer will be directed to the payment method page, where they must choose a suitable payment method. Next, the final payment method selection necessary to confirm the order and make the purchase will appear. The Buyer can choose the payment method and make the payment for their purchase. When placing an order, the Buyer must be attentive because the fast and trouble-free delivery of the ordered products depends on it.

The Sales Agreement is considered concluded from the moment the payment amount due under the Sales Agreement is received by Saunum Saunas OÜ or from the moment of signing the installment agreement. Unpaid order confirmations will not be fulfilled by the Seller.

2.4 Payment for Goods

Payment for Goods can be made through internet banking (Swedbank, SEB, Luminor, LHV Bank links).

In cooperation with our partners, you can also use the following financing options:

ESTO AS (available in Estonia, registered office: Laeva 2, Tallinn 10111, Estonia). ESTO’s 3-part payment or 12-36 month ESTO installment solution offers customers a flexible payment method for making purchases. There are no additional costs for the 3-part payment option. Orders financed through ESTO are confirmed only with a positive credit rating. For this purpose, we will forward your data to ESTO for address and credit checks. We can only offer you payment methods based on the results of the relevant checks. Your personal data will be processed in accordance with data protection laws and ESTO’s data processing rules. After making the payment, the online store will send the Buyer an order confirmation. An invoice for the order will be sent to the email address after the Goods are received.

All personal data obtained during the visit to the Saunum online store and the completion of purchases are treated as confidential information. An encrypted data channel with banks ensures the security of the Buyer’s personal data and bank details. Saunum Saunas OÜ representatives do not have access to encrypted data.

2.5 Delivery and Handover of Products

The Goods will be delivered to the delivery address provided by the Buyer in the order. Information about the delivery will be provided to the Buyer via the contact information specified when placing the order. The transport of the ordered Goods will be carried out in accordance with the transport conditions valid at the time of order placement.

When placing an order, the Buyer should ensure the accuracy of the contact information provided to avoid delays and misunderstandings in the delivery of the Goods. Saunum Saunas OÜ and the courier company are not responsible for delays in the delivery of the Goods or misunderstandings arising from inaccuracies or incorrectness of the data provided by the Buyer when placing the order.

The Goods will only be handed over to the Buyer based on the delivery note. Before signing the delivery note, the Buyer should carefully inspect the packaging of the Goods, and in case of damage to the packaging, make a corresponding note on the delivery note. In the event of damaged packaging, the Buyer has the option to refuse to accept the shipment and/or immediately inform Saunum customer service at info@saunum.com.

If the Buyer does not pick up the Goods within 14 (fourteen) days from the agreed date of receipt of the Goods, it is considered that the Buyer has breached the Sales Agreement and does not want the Goods. The Seller has the right to unilaterally withdraw from the Sales Agreement and demand compensation for damages (e.g., storage costs) and offset the damages incurred by the Seller with the amounts prepaid by the Buyer.

2.6 Right of Withdrawal

This withdrawal procedure does not apply in the case of withdrawal from a consumer credit agreement. Withdrawal from a consumer credit agreement is carried out in accordance with the procedures specified in the agreement.

2.6.1 The Buyer has the right to withdraw from the Sales Agreement concluded through the online store within 14 days without giving any reason.

2.6.2 The withdrawal period ends 14 days after the day on which the Buyer or a third party designated by the Buyer, who is not the carrier, physically takes possession of the Goods.

2.6.3 To exercise the right of withdrawal, the Buyer must inform the Seller of their decision to withdraw from the Sales Agreement in writing, which must be submitted to the Seller’s representative or sent by email.

2.6.4 Exclusion of the Right of Withdrawal

The right of withdrawal does not apply in cases where:

a. Goods delivered in sealed packaging have been opened after delivery and are not suitable for return for reasons of health protection or hygiene.

c. The subject of the Sales Agreement is a gift card and the unique code on it has already been used.

2.6.5 Withdrawal from the Sales Agreement

a. When withdrawing from the agreement, Saunum Saunas OÜ will refund the Buyer all payments received under the Sales Agreement, including delivery costs (except for additional costs resulting from the Buyer’s choice of a delivery method other than the cheapest standard delivery offered by Saunum Saunas OÜ) without undue delay, but no later than 14 days from the day the Seller receives notice of the Buyer’s decision to withdraw from the Sales Agreement.

b. Saunum Saunas OÜ will make the refund using the same payment method the Buyer used for the initial transaction, unless the Buyer has expressly agreed otherwise; in any case, the Buyer will not incur any fees as a result of such refund.

c. Saunum Saunas OÜ may withhold the refund until the Goods have been returned by the Buyer or until the Buyer has provided proof of having returned the Goods, whichever is the earlier.

d. To return the Goods, the Buyer must send or deliver them to Saunum Saunas OÜ at the address Suur-Paala 19, 11415 TALLINN, Estonia without undue delay, but no later than 14 days from the day the Buyer notified Saunum Saunas OÜ of their decision to withdraw from the Sales Agreement. The deadline is met if the Buyer sends the Goods back before the period of 14 days has expired.

e. The direct cost of returning the Goods shall be borne by the Buyer.

2.6.6 Reduction in the Value of Goods

The Buyer is liable for any reduction in the value of the Goods if such reduction in value is due to the Buyer handling the Goods in a manner not necessary to establish the nature, characteristics, and functioning of the Goods. The reduction in value is determined by Saunum Saunas OÜ.

2.6.7 Right of Withdrawal and Returning Goods

To exercise the right of withdrawal, the Buyer must inform Saunum Saunas OÜ (contact details above) of their decision to withdraw from the Sales Agreement by means of a clear statement (e.g., a letter sent by post or email). To meet the withdrawal deadline, it is sufficient for the Buyer to send their communication concerning their exercise of the right of withdrawal before the withdrawal period has expired.

2.6.8 Effects of Withdrawal

If the Buyer withdraws from the Sales Agreement, Saunum Saunas OÜ will refund all payments received from the Buyer, including the cost of standard delivery. This does not include additional costs resulting from the Buyer’s choice of a delivery method other than the cheapest standard delivery offered by Saunum Saunas OÜ. Saunum Saunas OÜ will make the refund using the same means of payment as the Buyer used for the initial transaction, unless the Buyer has expressly agreed otherwise; in any case, the Buyer will not incur any fees as a result of such refund. Saunum Saunas OÜ may withhold the refund until the Goods have been returned by the Buyer or until the Buyer has provided proof of having returned the Goods, whichever is the earlier.

The Buyer must return or hand over the Goods to Saunum Saunas OÜ without undue delay and in any event no later than 14 days from the day on which they communicate their withdrawal from the Sales Agreement to Saunum Saunas OÜ. The deadline is met if the Buyer sends the Goods back before the period of 14 days has expired.

The direct cost of returning the Goods shall be borne by the Buyer.

The Buyer is only liable for any reduction in the value of the Goods resulting from the handling of the Goods other than what is necessary to establish the nature, characteristics, and functioning of the Goods.

2.6.9 Obligations of Saunum Saunas OÜ in the Event of Withdrawal

Saunum Saunas OÜ will refund the payments received, including the cost of standard delivery, to the Buyer immediately or at the latest within 14 days of receiving the Buyer’s notice of withdrawal. Saunum Saunas OÜ may refuse to make a refund until it has received the Goods that are the subject of the Sales Agreement or until the Buyer has provided proof that they have returned the Goods, whichever is earlier.

Warranty

3.1 The Seller is responsible for the non-compliance of Goods sold to the Buyer with the terms and conditions of the Sales Agreement or for defects that already existed at the time of delivery of the Goods to the Buyer, and which occur within two years from the date of delivery of the Goods to the Buyer.

3.2 The Buyer has the right to turn to the Seller within two months of becoming aware of the non-compliance of the Goods with the terms and conditions of the Sales Agreement. The Buyer loses this right if they do not turn to the Seller within two years of the delivery of the Goods.

3.3 If the Goods sold to the Buyer have non-compliance with the terms and conditions of the Sales Agreement, the Buyer has the right to demand the repair or replacement of the Goods from the Seller. The Buyer has the right to demand a reduction in the price of the Goods or the termination of the Sales Agreement and the return of the Goods if the Seller is unable to repair or replace the Goods, if repair or replacement is not possible, or if it causes unreasonable inconvenience to the Buyer.

3.4 The Seller is not responsible for defects that occur after the delivery of the Goods to the Buyer.

3.5 If the Goods have a defect for which the Seller is responsible, the Seller will repair or replace the defective Goods. If the Goods cannot be repaired or replaced, the Seller will return all payments made under the Sales Agreement to the Buyer.

3.6 The Seller will respond to the Buyer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

3.7 The Seller is not responsible for any damage caused by the Buyer or for the non-compliance of the Goods with the terms and conditions of the Sales Agreement if:

a. the Goods have been used for non-domestic purposes;

b. the Goods have been repaired or replaced by a person not authorized by the Seller, or the Goods have not been used in accordance with the instructions for use provided by the Seller;

c. the Goods have not been used, stored, or maintained in accordance with the instructions for use provided by the Seller;

d. the Buyer has not followed the instructions for use provided by the Seller or has not taken into account the Seller’s recommendations regarding the use, storage, or maintenance of the Goods;

e. The Goods show signs of normal wear and tear.

Liability and Force Majeure

4.1 The Seller and the Buyer are liable to each other for any damage they cause to the other party by violating these Conditions in the cases and extent provided by the legislation in force in the Republic of Estonia.

4.2 The Seller is not responsible for the Buyer’s loss of profit or non-material damage.

4.3 The Seller is released from liability to the Buyer for the performance of the Sales Agreement if the non-performance of the Sales Agreement or the delay in the performance of the Sales Agreement is due to circumstances beyond the control of the Seller, the occurrence of which the Seller could not have foreseen or the occurrence of which the Seller could not have influenced. Such circumstances include, for example, strikes, fires, accidents in production, or energy supply disruptions without the fault of the Seller. The Seller shall inform the Buyer of the occurrence of such circumstances as soon as possible.

Personal Data and Privacy

5.1 The Buyer grants the Seller permission to process their personal data (including name, contact information, and any other information provided by the Buyer) to the extent necessary to fulfill the Sales Agreement and deliver the Goods. The Buyer also grants the Seller permission to provide the Buyer’s personal data to third parties (e.g., courier companies) for the delivery of the Goods.

5.2 The Seller processes personal data in accordance with applicable data protection laws and regulations. The Buyer can find more information about how the Seller processes personal data in the Seller’s Privacy Policy, available on the Seller’s website.

Final Provisions

6.1 These Conditions and the Sales Agreement are governed by the laws of the Republic of Estonia.

6.2 Any disputes arising from the Sales Agreement or these Conditions shall be resolved primarily through negotiations. If an agreement cannot be reached through negotiations, the dispute shall be settled in accordance with the legislation in force in the Republic of Estonia.

6.3 If any provision of these Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

6.4 The Seller reserves the right to amend these Conditions at any time. The amended Conditions shall enter into force upon their publication on the Seller’s website.
